A Lyndon Station man pleaded no contest to OWI-1st Offense. 38-year old Antonio Frias appeared in court yesterday before Judge Paul Curran. Frias had been charged with OWI, causing injury and operating with a PAC, causing injury. The prosecution asked that because of the plea agreement, count one be amended to OWI-1st offense and that count two be dismissed. In addition, Frias’ driver’s license would be revoked for eight months, and that there be an ignition interlock in Frias’ vehicle for 13 months. Judge agreed with the prosecution and found Frias guilty due to his no contest plea. Online court records show that Frias will also have to pay a fine of almost $940 and take part in Alcohol and Other Drug Abuse (AODA) Prevention Program and any other necessary followup.
According to the criminal complaint, on February 5, Frias was involved single vehicle crash that left him and his passenger injured in the Town of Kildare. They were both transported to Mile Bluff Medical Center with non-life threatening injuries. Frias admitted to law enforcement he had been drinking earlier that night and that he was the driver, but said that the passenger had grabbed the wheel, causing the accident. Police talked to the passenger and she told them that she couldn’t remember anything about the crash. A blood test showed that Frias’ blood alcohol concentration was .140.
